Ignore that other person. Desktop ponies took several of the icons I made and then turned around and claimed I was stealing from them. Added me to some list of thieves and have harassed me on several occasions.

Th3BlueRose makes a very strong case... but it would be unjust of me to simply accept their word blindly. ...for now I'll hold off on the offer-mainly because my project still has a few months before I can even move it from the idea phase-but if there is any legitimate proof of your innocence by that time, then I would certainly love to work with you. I hope you don't mind my skepticism, I just don't want to be caught up in anything immoral if there is a chance you're stealing. With the argument against you is certainly looks as though you are.. but you did provide evidence against this. Which is why I want to give you a chance to clear your name so to speak, and if you can, then I promise to defend you from anyone else with similar claims about you. For now though, I'll walk the path of neutrality. I'm sorry.

Did you see the link I posted? It's an example of one of the timers I was accused of stealing sprites. You can see there are numorous sprites between the one I made and the one I was accused of stealing.

All the desktop ponies are is the animations taken directly from the show and then shrunk down. That is technically already copyright infringement.

"17 U.S. Code § 106 - Exclusive rights in copyrighted works

Subject to sections 107 through 122, the owner of copyright under this title has the exclusive rights to do and to authorize any of the following:

(2) to prepare derivative works based upon the copyrighted work;

Meaning that only the original copyright owner has the right to make derivative works. In this case it'd be Hasbro who owns the copy rights to things like the animation walk cycles used in My Little Pony Friendship is Magic.

What is a derivative work you ask?

" A “derivative work” is a work based upon one or more preexisting works, such as a translation, musical arrangement, dramatization, fictionalization, motion picture version, sound recording, art reproduction, abridgment, condensation, or any other form in which a work may be recast, transformed, or adapted. A work consisting of editorial revisions, annotations, elaborations, or other modifications which, as a whole, represent an original work of authorship, is a “derivative work”.

Meaning transforming part of the show, such as a walk cycle of a copyrighted character, into tiny pixel form is... you guessed it, a derivative work.  Meaning that Fanart, an the Desktop ponies for example, is an infringement of Hasbro's rights. Meaning that Desktop ponies does not own the rights to things like the concept of pixelization of Hasbro's copyrighted work. Technically only Hasbro has the right to such derivatives.  Hence "Fighting is Magic" being taken down for both copyright and trademark infringement.

Which means that any other fan is just as free to translate the animations from the show into pixel versions. It's at Hasbro's discretion.


And yes that it literally all that Desktop Ponies is Animations taken from the show and then rendered into pixel form. That's all I do as well. And no I don't do it for money. I have never received any money for any of the requests I've received. You could try and find my commission information if you want, but I'll make it easy for you. You won't be able to find it as it has never existed as I've never taken commissions. The closest thing I've done is do art trades. Someone makes art for me and in return I make art for them. There's no monetary value associated so its still not a commission.

Clearly they're not the same thing. It's like I made fanart of Cheerilee, and someone else did as well. And someone else has the exclusive right to make fanart of cheerilee? that other person is the only one allowed to violate Hasbro's copyright? Sounds rather ridiculous don't you think?

And if I was such an art thief then why hasn't my account been closed?

also another time I was accused of stealing an Apple Bloom. I uploaded mthe apple bloom I made in July. Then the person who claimed to have made Apple Bloom uploaded one in August. They then tried to bully me into taking down the one I made and uploaded first.

Now... How could I have stolen their work that they posted in August, Gone back in time, and posted something early enough that some one else could have commented on? Doesn't make any sense does it? I stole something before it was made available? How does that even work? More likely they want to be able to claim sole ownership of fan art presented in that way.

No, there have been times that my work was "stolen" by the desktop ponies team and then they turn around and harass me. Of course since I don't own the copyrights to copyrighted characters, I don't really care that much about works involving those. It's just irritating when they or fans of them come back and claim I stole from them.

These people will see a similarity and then assume that one is a rip off of, or stolen from, the other.

So yeah, I've never stolen anything, Deviant Art would have removed the piece or something, probably ban my account... which they haven't done.
I have timestamps of my work predating theirs.
My work is also different from theirs.

And much like the twilight fans accusing anything that uses a werewolf of stealing from Twilight... T3hBlueRose is deluded. As is the desktop pony team and their fans.

Hmm... everything you say makes perfect sense, and there really are no discrepancies... I do have one last question though. How did these claims come to be? Why are you the sole victim of these peoples actions? It simply doesn't feel like something somebody just decides to try out one day;to gather their friends together and have them all accuse someone innocent of art theft. I don't see what they gain from it, especially if you don't make money off of your work. Is there any motivation behind their actions?

I imagine fans of The Desktop ponies team seeing my work and making assumptions.  I've seen my work turn up in various different places. Like my concept for Scootaloo's cutie mark, or the Apple Bloom head tilt. I turned that into positive dialouge with the person that was using my work. Like I said I don't own the copyright on the works involving canon characters so I'm fine with people using those. 

But some people might have seen my work somewhere and assumed I stole from someone else. Like with the Cheerilee one where they thought I stole it, but it was actually rather different.

I don't know if I'm the sole victim of their harassment or not. I'd imagine I wasn't, but haven't bothered to look into it.

I could only speculate about their motivations. Since my communications with them haven't been the most civil. They come out swinging  calling me a thief and human scum and more colorful insults that indicate that they're not willing to listen to reason...
One of the possible motivations I suspect might be if they bully me into taking my work down they can upload it and claim it as their own. Since Deviant art includes time stamps as to when it was uploaded, should I (or anyone else) ever choose can use those time stamps to prove who created it first. If I take down my work the timestamp goes with it. then should I try to reupload they'll have a timestamp earlier than mine. (Like on that apple bloom one where my timestamp predates theirs).

Some might just be a misguided sense of justice. The same sort of thing that lead to the whole debacle with Derpy Hooves that wound up with an episode being edited and Derpy going missing for a while and then popping up but remaining silent. a handful of people cried about Derpy's depiction being ableist. Meanwhile people I know that are disabled, one in particular is missing one of her eyes so will sometimes have her eyes pointing in two different directions since one's glass. She loves Derpy, made her feel represented in the show.  But the white knights "defended" the disabled "on their behalf". So likewise if they felt that I stole from The Desktop Ponies team their fans would feel the need to attack me over it. (Even though I really didn't steal from them since I have no need to since I can make sprite art just fine).

But like I said its all just speculation since I don't know their motives. And if they've gone after me odds are they've gone after others in a similar way.
