actually looking at that animation and hers, hers is pixilated for one. it is also going the opposite way. The style is different. and do you not know that other people can have the same idea as you?

you're kidding me right? ....... she is speaking to the artist so you need to stop trying to talk down about her. all because of this thing. she still creates amazing art and so does he... but they both have very different styles. apparently you don't see that. and right now I'm going against what I've said, because artist during this situation don't need us to handle there problems. so stop saying she's a bad person for this and just leave, ok? seriously.

Yes she's talking to the original artist and even if they had the same idea she traced. The original artist did not upload it as creative commons copyright. Even if he did copyright his animation under creative commons she would still be required to credit him. Tracing is not influence. Tracing is a copy.
Don't worry it's a video because some like to read despite how much more it benefits people.

What you just did with this tutorial, you are devaluing the value of the original work. Another reason why this gif isn't considered anywhere near fair use.
Not only that but you're teaching others how to steal his copyrighted material. Fair use is a slippery slope. I really don't understand how disrespectful you're being right now. The artist kindly asked you to stop and just because you insist what you are doing is not wrong, it doesn't exempt you from the law. Believe it or not you're breaking the law and just because it's a common practice, it doesn't mean you're immune to the law.
Don't worry, it a video explaining what copyright REALLY is and not what you think it is. You won't have to read anything.

This was to show how I used the timeline function in photoshop.
I am not teaching others how to steal, this could apply to any icon base someone is using or making.Β
It's the easiest way, that I have found to use the timeline in photoshop.
This matter has been settled with Petey and I would appreciate it if you left me alone.Β

Honestly, I'm tired of being told what I "should" do. And I will hide anything in relation to the idea this is stolen because legally, it is not. Until I receive further correspondence from petey I do not care to have comments on the matter shown.

But either way I guess the matter has ended. I thank you for taking down the commission as well as linked credit. Honestly that's all we wanted to happen.
Technically if you would scale it up, place it over the animation flipped, it would be the EXACT same animation. It's similar to tracing something from say someone else's picture but changing up the arm and leg poses, flipping it around and changing the color scheme. It's still the exact same thing and it still means you have taken something from somebody who did NOT wish for it to be published elsewhere, and claiming it as your own when you don't know how long it took for them to make said piece.
But so long as you take down what will be sold, with money as well as points, it's just fine. That was the only deal breaker to all of this.
I'm sorry if I came off a little strongly, but on deviantART this kind of thing happens quite a bit because no one says anything to the artist beforehand. I also just feel strongly about this.

I can understand how people would be upset. But like I said, legally I've done nothing wrong no matter the "technicalities".Β
I am discussing with Pikapetey how he would like this to be handled, and frankly I'm a bit irritated with other people trying to tell me what I need to do with it. The only opinion I will consider is his, so until I finish conversing with him, things will stay as they are.Β

Ah I see. I do understand some comments as coming across a bit unorthodox, they're mostly people who don't understand how to handle things.

I get that. I have been the victim of theft on more than one occasion, and I know when it is and when it isnt theft. I report and move on.Β
Deviantart even considers recolors to be okay. You could take an exact image I drew, recolor it with photoshop or MS paint bucket tool and it would be perfectly legal to do.Β
I'm not saying I agree with this, but If I had taken an animation cycle from the MLP TV show and done the same thing, even Hasbro couldnt do anything about it. And people would applaud me.
So, I am sorry that Pikapetey is upset about it. And his friends and fans find me guilty no matter what, but I will skip over and disregard rude and crude comments.Β

Aha yes. That's certainly true, I guess int instance is different depending on deliberately tracing it and just doing it for reference. Much could be said about the pony turnarounds that are being distributed, but they are not sold mind you, which is fine in a way. And proper credit is used, I think?
That's just fine, I am a friend of his but I believe that using harsh words and profanities will not do anything but make the user feel worse, which is not the primary intention.
