In a fanfiction I´m working on, there even is a somewhat logical reason for Penny to still be alive in the actual show. It´s based on a theory according to which Penny meeting Ruby had some effects on her programming.
The short version is that various random lines of code began popping up, mostly due to Penny´s cybernetic brain developing at an much higher rate than what it was built for. When Penny was hit by Pyrrha´s semblance, the powerful electro-magnetic shock caused these lines of code to clump together and form a new program, which served only one purpose: Self-preservation.
When Penny realized that she wouldn´t be able to survive this impact, her new program transferred her entire mind to another place, so it could be saved. This place, of course, was Ruby´s scroll.
Now, I know the biggest problem here: If Penny has been on Ruby´s scroll the entire time, why didn´t she say something? Easy: She couldn´t. I mean, we´re talking about a human brain, in terms of processing power, being uploaded onto a scroll. That´s like putting the entire iTunes store on a single cellphone.
However, now that Ruby is in Mistral, and close enough to the CCTS Tower of Haven Academy, it might be possible for Penny to upload her consciousness onto the tower´s computers and leave her dormant state on Ruby´s scroll.
Also, I like to think that Qrow would ask her to hack every single scroll nearby and search for any mentionings of the name Salem, but that´s just an idea of mine.

That sounds like a fun idea. And I agree that they could definitely find a way to bring Penny back if they wanted, even Penny having back ups of herself already sounds perfectly rational (or the people who built her having back ups of her mind). The only thing is what would happen with her aura, is that attached to her conciousness still? But obviously aura can be moved so its certainly possible that it transeferred somewhere else.
And thats an interesting thought about Pyrrhas semblances affecting her brain/computer, especially when she used it on her. I hope that RT come back to this and make more out of Penny's story.
Its also a fun idea to have Penny temporarily live in Ruby's scroll, I can imagine that!

Well, Penny doesn´t live in Ruby´s sroll. A scroll doesn´t posess nearly enough processing power to handle Penny´s brain, so Penny would be on "standby mode" or something, until Ruby gets close enough to Haven Academy and Penny´s consciousness is transferred to the school´s main computer.
So, basically that could happen first thing next volume. Or, you know, very early on.
Man, it´d be kind of weird if the original Penny just exists on Haven Academy´s main computer, and a second Penny, or Jenny, shows up, with the same core program as the original one.

Ah yeh that is true, I was just thinking of how funny Ruby's reaction would be :') but that does make more sense.
It would be really weird, especially if it was more of a clone of Penny then say, a part of her. It'd suck if it wasnt the original Penny.

I already got something like a fanfiction ready, and since I can imagine someone would like to read it, here I go:
Ruby turned off the light and laid down, ready for a well-deserved rest after her journey to the kingdom of Mistral. Her uncle Qrow had disappeared a few days after he had recovered, but he had assured her that he would be around to watch over her, and she was too tired to worry about it right now anyway, so she just drifted off into the sweet realm of sleep. Just before she fell asleep, she thought she heard a faint beep, as if her scroll had recieved a message.
The next morning, after breakfast, Ruby checked her scroll and saw that she indeed had gotten a message. She didn´t recognize the number, but it intruiged her nonetheless, so she opened it and began reading: "Meet me. CCTS Tower." After confusion had passed, Ruby put away her scroll and followed the request.
As Ruby entered the CCTS tower of Mistral, she noticed how dark, almost dead, everything seemed. "Well, not a big surprise. With the CCTS down, this place is retty useless", she thought. Just as Ruby was about to call if anyone was there, the holographic receptionits popped up and said: "Greetings, Miss Rose. You have a call. Shall I patch it through?" Ruby hesitated a little, but then replied: "Yes, thanks." The holographic receptionist said: "Alright, please take a seat." A nearby computer lit up, and Ruby sat down before inserting her scroll into the slot. At first, nothing happened, but then a messae popped up, saying: "Initiating data transfer." Ruby was about to ask for help, when she noticed an all too familiar symbol in the middle of the loading circle. The laoding bar filled so slowly that Ruby thought: "Well, I guess there´s no harm in me doing something else in the meantime." She got up from her seat, let her scroll in the slot, and went to the exit. The holographic receptionist asked: "Have you finished all your business?" Ruby answered: "No, but there is a very big data transfer going on, so I´ll take a walk around town. I´ll be back in about an hour, though."
Ruby was walking through the city of Mistral, when she came across Ren and Nora. Nora asked: "Hey, Ruby. Where´ve you been all morning?" Ruby answered: "Well, I got a message telling me to go to the CCTS tower, and now my scroll is occupied receiving a lot of data from somewhere. Anyway, could you tell me what time it is?" Nora was about to get her scroll, when Ren gave them a sign to be silent. Giving the two huntresses a sign to follow them, he went into a dark sideway and, once out of sight of the common folk, drew his weapons. Ruby, drawing Crescent Rose, said: "Not again." Nora drew Magnhild, in its hammer form, and said: "Let´s see how well they can run away when we break their legs." Ren was the first to open fire, aiming at a chimney. A mysterious figure jumped above the chimney, and Nora switched Magnhild into ranged mode before aiming at the figure. Ruby, using Crescent Rose´s sniper mode, shot an ice-dust bullet at the target, encasing it in ice entirely. The figure crashed against a wall, broke free from the ice and was clearly visible to the trio now. It as a huntress, roughly Qrow´s age, who wore marine blue shorts under a combat skirt out of copper plates, a blue tank top and black, detached sleeves around her lower arms, which were held in place by brass rings around her wrists and above elbows. She wore a black headband on her head, and her hair looked as if it was tied to a ponytail. Ruby asked: "Can´t you guys just leave me alone? What do you even want?" Ren and Nora positioned themselves in front of Ruby, and Ren said: "Ruby, get to safety. We´ll keep her from following you." Ruby said: "No way. I won´t let you put yourselves in danger because of me." Ren said: "I know. Then let´s show her what we´ve got." He rushed towards the woman, who let her scepter, a golden, short staff with a red pearl on top of it, extend to a trident, before she blocked Ren´s attack. He jumped over the woman, caught her trident with Stormflower and held her in place. Nora, who had already begun swinging Magnhild, was about to hit the woman when suddenly, a powerful burst of water threw Ren against a wall and launched Nora across the ally. Ruby looked at the woman, then at her friends, and back at the woman, who now slowly walked up to her. Ruby spun around Crescent Rose, knocking the woman off her feet, and kicked her against a wall before slamming Crescent Rose into it to trap her opponent. Ruby said: "Now, what do you want from me?" The woman answered: "For beginners, your friends attacked first. I only defende myself. Also, I´d like you to look me in the eye. Do you really think I want to hurt you?" Ruby looked the woman in the eyes and, for a moment, was speechless. "You... You have silver eyes."
A few minutes later, in a nearby café, Ruby asked: "So, who are you?" The woman answered: "My name is Sirena Blue. After the events during the Vytal Festival, my team leader has decided that it was best if I watched over you. Now, if you would excuse me, we shouldn´t even have this conversation right now." She emitted a cloud of steam and, when it was gone, so was Sirena. Ruby looked at the clock hanging above the counter, and noticed that it has been over an hour since she left the CCTS tower. "Sorry guys, but I´ve got to go!", she said, as she ran out of the café and headed towards the CCTS tower.
The holographic receptionist said: "Hello, Mist Rose. You are late." Ruby said: "I know." She hurried to get to the computer her scroll was still plugged into, and saw how the information transfer was completed. Suddenly, all the computers lit up, at first blue, before turning light green. On the screen in front of Ruby appeared a massive wall of computer codes, which slowly merged into a plain, white background, and a face appeared in front of it. Ruby gasped and asked: "Penny? How is this possible?" Penny answered: "Hello, Ruby. Are you... crying?" Ruby answered: "Of course. I thought you were gone." Penny said: "Me too. But my program somehow got transferred to your scroll, and now that I am on these computers, I can talk to you again." Ruby asked: "You mean, you´ve been on my scroll this whole time? Why didn´t you say anything?" Penny answered: "I couldn´t. Your scroll would´ve overheated the moment I tried doing anything, so I went into standby mode until you got here. That´s when I decided to send a message to your scroll." Ruby heard something at the door and turne dher head to look. Ren, Nora, Jaune and Qrow had entered, and were walking towards her. Nora asked: "So, what kind of data is it you´re getting there?" Ruby wiped her eyes and answered: "Turns out, my scroll wasn´t recieving any data." Nora asked: "Wait, so you were sending data without knowing it? Do you at least know what data it was?" Penny´s face popped up on a screen behind her and she said: "It was me." Nora jumped a little and everyone turned around. Nora asked: "Wait, are you some sort of robo-ghost now?" Penny answered: "Well, I suppose that could be a fitting term." Jaune, with a rather flat tone, said: "Well, good to see you´re still with us." Qrow asked: "So, Ruby. Ren said you ran into a huntress named Sirena Blue. That right?" Ruby answered: "Well, yeah. She said she has been watching over me for some time now, but she disappeared before I could ask any questions." Qrow said: "I see. You know, you should be happy she´s on our side." Nora asked: "Why? I mean, we fought her, and if Jaune and you were around, she wouldn´t stand a chance." Qrow, speaking with a slightly laughing tone, said: "That´s what you think. Truth is, though, she´s part of a team of exceptionally skilled huntsmen and huntresses." Jaune asked: "So, why didn´t she help us against this Tyrian guy?" Qrow answered: "Well, based on what I´ve seen of her in terms of combat skills, she either knew we´d handle it or she didn´t want to put us in danger." Penny said: "I don´t mean to sound rude or anything, but Ruby, you can take your scroll with you if you want. All my programs are safe and sound here on the processors of this tower, so I don´t need it anymore." While Ruby unplugged her scroll, Qrow asked: "Penny, if you´d like to help me out a little, I´d really appreciate if you could stay in contact with me. Can you do that?" Ruby said: "Me too. I´d like to talk to you from time to time, but I don´t think I could walk here all the time." Penny said: "Alright, will do." A short sound signaled that both Qrow and Ruby´s scrolls had recieved a message, and Penny explained: "It´s a small app I put together so you can contact me whenever you feel like it."
Ok, this was longer than expected. And yes, Sirena is one of my OCs. I kinda mixed this fanfiction with the one where each member of Team RWBY has a member of Team ANST watch over them. Here´s a list of who watches over whom:
Argent Star watches over Blake (and, by extention, Sun)
Niob Bolt watches over Weiss (yes, I´m fully aware that that´s a horrible idea)
Sirena Blue watches over Ruby (Sirena actually insisted that the team watches over Team RWBY)
Talia Star watches over Yang (overly energetic technology expert meets huntress with robotic arm, what could go wrong?)
