InΒ reality it doesn't quite work like that. The National Emergency Powers only allow the President to make funding decisions like this. It does not allow any legislation. Neither example you cite is funding issue. Even if you did make the attempt, such laws would be struck down as Unconstitutional by the first challenge
You'll note that nobody questions the legality of building a wall on the border. It's well established that the Constitution gives the Executive Branch the power to make the decision a wall needs to be built there. It's just the funding for the wall normally has to go through Congress. Now thanks to the precedent set by many former Presidents from FDR to Obama, Trump is using the National Emergency powers to get a job done that partisan bickering has made impossible. Which is a shame as if you look back in the records of the obstructionists they had previously spoke of a need for a wall ad even at one point voted to fund it to the tune of 50 billion, but then later misappropriated that funding. They have also used US tax payer money to fund walls in other countries. So their opposition here is just politics. Β
